All his lands in Virginia to William Waters his son.

All his other goods in England, Virginia, Ireland or elsewhere to be sold by his executor on the advice of his brother John Waters of Midleham, Yorks, and Mr. Lionel Rowlston of Elizabeth City, gent., and the proceeds equally dividied between his wife Mrs. Grace Waters, son William Waters, and daughter Margaret Waters; the children's portions to be used by overseers in their minority etc.

Appoints his son William Waters as executor.

Signed 20 August 1630 at Great Hornemead, herts. Codicil directs payment of L88 to his friend Mr. Pennington at the Red Lion in Cheapside; it is payment for frieght, customs, and other charges on testator's tobacco now in Pennington's cellar "in panne therefore".

Witness Daniel Cage, Phil. Cage, Solomon Cole (his mark).

Probate 18 September 1630 to John Waters, brother of deceased, in minority of William Waters, son and executor.

Index states that testator died at Hormead [sic] Herts. Without source.

To his son William Waters all the plantation where testator now lives in the county aforesaid, also the plantation on the north side of Hungers Creek, also his gold seal ring, his "soruetore" and the chest of drawers and English table in testator's hall chamber, also his biggest table and looking glass and the wicker chair; also all his Negroes, male and female, except one Negro boy called Amsbury, who is given to testator's grandson Thomas, the son of Zerruble Preeson and Margaret his wife.

To his granddaughter Isabell, daughter of said Zerruble and Margaret L25 to be laid out by his executor for a good and likely female Negro slave.

To his son Wiliam Waters all his livestock, except a mare had from Zerruball Preeson, which goes to the latter's son Thomas Preeson; and the mare colt from her to Z. Preeson's daughter Isabell; and the horse from Z. Preeson to latter's wife Margaret.

To his son William Waters all his silver plate, except a large silver salt marked WWI, which is for testator's daughter Margaret Preeson.

Any cash to be used to discharge his office with, and any residue to his granddaughter Isabell.

All book debts owed him in Virginia on his own account to his son William Waters.

To his daughter Margaret Preeson his white woman servant and her daughter Mary, during the time they have left to serve him.

His servant man John Robins to his son William.

To Robert Bayton L10 or the value thereof.

The remainder of his household goods, tobacco unshipped, and corn (more than required for the family's keep) to be divided, two thirds to his son William and one third to his daughter Margaret (who has formerly had a share).

To his son William his sloop called the Isabel and the flat belonging to her, also his two-masted boat.

The eighth part of the sloop Dolphin in equal shares to his son William Waters and Zerrubll Preeson.

All estate in Great Britain to be divided equally between his son William Waters and his daughter Margaret Preeson.

Names his son William Waters as executor, and forbids any appraisement of his estate.

Probate London 22 October 1722 to William Waters.

Marginal note records admon 21 October 1757 to Anthony Bacon, administrator for William Waters, deceased, executor and son of William Waters, widower, deceased; for use of William Waters, now residing in Williamsburg, Virginia, son of aforesaid executor, who died intestate; no residuary legatee is named and Margaret Kincade, formerly Preeson, wife of —- Kincade, died without taking letters of admon.

P.A.B. notes testator was late of Northampton County in Virginia and died abroad.
